The beginning of partial application of the AI Act as regards general provisions and prohibited practices

On 2 February 2025, Regulation (EU) 2024/1689 of the European Parliament and of the Council of 13 June 2024 laying down harmonised rules on artificial intelligence and amending Regulations (EC) No 300/2008, (EU) No 167/2013, (EU) No 168/2013, (EU) 2018/858, (EU) 2018/1139 and (EU) 2019/2144 and Directives 2014/90/EU, (EU) 2016/797 and (EU) 2020/1828 (AI Act) became partially applicable as regards general rules and prohibited practices that may cause harm or lead to disproportionate treatment of natural persons. Prohibited practices set out in the Regulation include, but are not limited to, the use, putting into service and placing on the market of AI systems that:

  • use subliminal and manipulative techniques to influence decision-making;
  • exploit vulnerabilities of individuals such as age, disability or socio-economic background;
  • carry out profiling of persons on the basis of their behaviour or personality traits in order to assess their likelihood of committing criminal offences;
  • analyse the emotions that accompany individuals at school and work;
  • use biometric data to create profiles of individuals and draw conclusions about their race, political opinions, religious beliefs or sexual orientation;
  • expand facial recognition databases by acquiring images from the internet or security cameras;
  • carry out real-time biometric identification for law enforcement purposes, unless their use serves to detect serious crimes such as trafficking in human beings, abductions, sexual exploitation or acts of terrorism.
