Regulatory Technical Standards specifying records to be kept of all crypto-asset services, activities, orders and transactions undertaken

On 10 June 2025, Commission Delegated Regulation (EU) 2025/1140 of 27 February 2025 supplementing Regulation (EU) 2023/1114 of the European Parliament and of the Council with regard to regulatory technical standards specifying records to be kept of all crypto-asset services, activities, orders and transactions undertaken was published.

The Regulatory Technical Standards ("RTS") were developed on the basis of the delegation set out in Article 68(10) of the MiCA Regulation[1]. They clarify, among others, the following matters:

  • the retention and keeping of records concerning specific crypto-asset services and the activities of crypto-asset service providers;
  • the record-keeping of documents setting out the crypto-asset service provider’s and the client’s rights and obligations, record-keeping in relation to the safekeeping of clients’ crypto-assets and funds, orders and transactions, and the reception and transmission of orders;
  • the identification of persons or computer algorithms within the crypto-asset service provider making investment decisions and determining the conditions for executing transactions;
  • the identification of crypto-assets, clients that are legal entities, and crypto-asset service providers executing orders and transactions.
